Mobi Terms of Use

Effective from

These terms govern your use of Mobi, a messenger app for talking with the businesses you use, operated by ORCARSTUDIO Inc. (오르카스튜디오 주식회사, Business Registration No. 576-87-02239, "ORCARSTUDIO", "we", "us"). By creating an account or using Mobi you agree to these terms and to our Privacy Policy.

1. The Service

Mobi lets you add businesses that use Mobi (for example by opening their link or scanning their QR code) and exchange messages, photos, videos and files with them. Businesses may answer with their staff, with an AI assistant acting on their behalf, or both. Mobi can translate messages between you and a business, and can notify you of new and urgent messages.

Mobi is free for customers.

2. Your account

  • You must be at least 14 years old to use Mobi.
  • You sign in with your email address (with a one-time code), with Apple or with Google. Keep access to that email or account secure; you are responsible for activity on your account.
  • Give a name that is not misleading and do not impersonate anyone.
  • One account is for one person.

3. Businesses on Mobi

  • Only businesses approved by ORCARSTUDIO can be added and can message you.
  • When you add a business, it receives your display name, email address, phone number if you added one, and what you send it, as described when you add it and in the Privacy Policy.
  • Each business is responsible for its own messages, offers, products and services, including any contract you make with it (such as a car-rental agreement). ORCARSTUDIO is not a party to those contracts and does not guarantee a business's services.
  • Replies written by a business's AI assistant and automatic translations can be wrong or incomplete. Check important information, such as prices, times and conditions, with the business.
  • You can block a business at any time. A blocked business cannot send you messages, including urgent ones, until you unblock it.

4. Notifications and urgent messages

A business can mark a message as urgent. Mobi then tries to make sure it reaches you: as an urgent push notification and, if that cannot reach you or the message stays unread, by email and, if you added a phone number, by text message. We do our best to deliver notifications, but delivery depends on your device, its settings, your network and third parties, and is not guaranteed. Mobi is not an emergency service. In an emergency contact the local emergency services.

5. Your content and conduct

You keep the rights to what you send. You give ORCARSTUDIO a limited licence to store, transmit, translate and process it as needed to provide the Service to you and to the businesses you talk with.

There is no tolerance for objectionable content or abusive users. You must not use Mobi to send or share:

  • anything illegal, or that promotes illegal activity;
  • harassment, threats, hate speech or content that demeans people based on who they are;
  • sexually explicit content, or any content that sexualises minors;
  • violent or graphic content meant to shock;
  • spam, scams, phishing, malware or unsolicited advertising;
  • content that infringes others' rights, including privacy and intellectual property;
  • other people's personal information without their consent.

You must not interfere with the Service, try to access accounts or data that are not yours, reverse engineer the apps except as the law allows, or use automated means to access the Service.

6. Reports and enforcement

You can report a message by long-pressing it and choosing Report message, and you can block a business from its information screen. We review reports and act on them, which can include removing content, warning, suspending or removing a business or a user, and informing the authorities where the law requires. We can also act on our own when we become aware of a breach of these terms.

7. Suspension and ending your account

You can delete your account at any time in the app (Settings → Delete account) or at joinmobi.link/delete-account. You are signed out immediately and the account is erased after 30 days; signing in again before then restores it. What erasure removes and what remains is described in the Privacy Policy.

We may suspend or end your access if you break these terms or the law, or if your use puts other users or the Service at risk. Where possible we tell you why and give you a chance to respond.

8. Changes to the Service and to these terms

We may change, add or remove features. If we change these terms, we announce it in the app or on this page at least 7 days before the change takes effect (30 days for changes that are unfavourable to you). If you do not agree to the new terms you can stop using Mobi and delete your account; if you continue to use Mobi after they take effect, you accept them.

9. Intellectual property

The Mobi apps, website and brand belong to ORCARSTUDIO or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the apps for their intended purpose under these terms. If you downloaded the app from the App Store, Apple's Licensed Application End User License Agreement also applies, and Apple is not responsible for the app or its support.

10. Disclaimers and liability

We provide Mobi with reasonable care, but we do not promise that it will always be available, uninterrupted or free of errors. To the extent the law allows, ORCARSTUDIO is not liable for damage caused by a business's messages, services or contracts, by automatically generated replies or translations, by the failure of third-party networks or devices, or by force majeure. Nothing in these terms limits liability that cannot be limited by law, including liability for our intentional misconduct or gross negligence.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. Disputes will be resolved by the court with jurisdiction under the Civil Procedure Act, with the Seoul Central District Court as the court of first instance where the law permits a choice. This does not take away rights you have under the consumer protection laws of your country of residence.
